How to Buy or Sell in the Name of an Entity (trust, LLC, or a corporation)

If you are selling or buying under the name of a family trust or another entity, it’s very important you follow these instructions very carefully. Following these steps will help ensure the binding legal Purchase Agreement is completed properly.

For Sellers:

1. At Listing Input 

  1. At Listing Input, you need to put the full legal name of the entity in the Seller Name area
  2. Enter the email address of the representative (Trustee, President, Manager, etc.)

NOTE: If you have already uploaded your listing to Homepie and it has been approved by Homepie, you can go into Edit Listing in your Dashboard and update the Seller Name field.

2. In DocuSign (once proposed offer terms are accepted by all parties)

When you finally accept an offer, you will need to make a couple changes to the name field in DocuSign.

  1. Click the first initial box as if you are clicking to initial it
  2. A window will come up that says Adopt Your Initials
  3. You will need to edit the Full Name and the Initials fields
  4. Currently you will see the name of the trust you entered in Seller Name on the listing input page. Change that to ‘John Smith, Trustee’, or whatever corresponds to the entity type you are selling under
  5. At the very end of the purchase contract, after you sign in sections 14 or 15, check the box that indicated you are signing in a representative capacity (see image below)

For Buyers:

1. At Offer Creation

  1. Click Start an Offer from the listing page
  2. Enter the full legal name of the entity in the Buyer Name area
  3. Enter the email address of the representative (Trustee, President, Manager, etc.)

NOTE: You will not be able to change this after you submit your proposed offer

2. In DocuSign (once proposed offer terms are accepted by all parties)
